The Lee County judge presiding over Courtney L. Lockhart's case has scheduled a hearing for March.
Lockhart, 24, of Smiths Station, was charged for the slaying of Auburn University freshman Lauren Burk of Marietta, Ga., March 4, 2008.
Burk, 18, was killed by gunshot and found on Ala. 147 near U.S. 280. Her car was later found in the Hinton Field parking lot on fire, according to Auburn police officials.
The Alabama Supreme Court has ruled Lee County Circuit Judge Jacob A. Walker III will remain on the case Feb. 2.
Lockhart's attorney, Jeremy Armstrong, filed a request in October 2008 asking for the removal of Walker from the case with the state court of criminal appeals and later appealed the denied request to the Alabama Supreme Court in December 2008.
Capt. Tom Stofer of Lee County said Walker has set a gag order on the case.
The gag order prohibits anyone involved in the capital murder trial from talking about any details or information regarding the case.
