District attorney drops opposition to venue change in Updyke case

Robert T. Treese III, Lee County district attorney, has dropped his opposition to a change of venue in the Harvey Updyke Jr. trial, according to the Opelika-Auburn News.

Updyke is accused of poisoning the oaks at Toomer's Corner in downtown Auburn.

Treese has asked Lee County Circuit Court Judge Jacob Walker III to find a different venue outside of Lee County for the case to take place, according to the Opelika-Auburn News.

At Updyke's Feb. 13 hearing, the defense said it would be impossible to have an unbiased jury in Auburn because the community or anyone involved with the University is a victim in the case.

Currently, Updyke is being held at the Lee County Detention Center after Walker revoked Updyke's $50,000 bond at his Feb. 13 hearing for allegedly violating the terms of his bond when he was arrested in Hammond, La. on Sept. 24, 2012.

A status hearing is set for Friday, March 15 to discuss change of venue.
